1. General
These Terms of Use (the “Terms”) govern your use of the Smakota website (the “Site”). The Site is owned and operated by the Smakota editorial team (“we”, “us”). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
The Site is informational, free of charge and requires no registration.
2. Nature of the content
Recipes, tips and other materials on the Site are for general information and home cooking. They are not medical, dietary or other professional advice and do not replace advice from a doctor. Labels such as “Healthy”, “Low-calorie”, “Gluten-free”, “Dairy-free”, “Vegan” and “Lenten” are editorial guides, not a guarantee or certification.
Calories and nutrition values are approximate. Dish photos are illustrations created with artificial intelligence, so your result may look different. How we prepare and check our content is described in our Editorial Policy.
3. Allergens and food safety
- If you or your guests have an allergy or intolerance (including to gluten, milk, eggs, tree nuts, peanuts, soy, fish, crustaceans, molluscs, sesame, mustard, celery, lupin or sulphites), check the ingredients and labelling of every product carefully.
- Follow good hygiene, safe cooking temperatures and storage conditions. Dishes with raw or undercooked eggs, meat or fish, and unpasteurised products, are not recommended for pregnant women, young children, older people and people with weakened immunity.
- Take care with hot surfaces, oil, knives and kitchen appliances, and follow the manufacturer’s instructions.
You decide whether a recipe is suitable for you and are responsible for preparing and eating the dishes.
4. Intellectual property
The texts, collections, design, logo, photos and other materials on the Site are protected by copyright and related-rights law and belong to us or are used lawfully.
Without asking us, you may:
- cook dishes from our recipes;
- print and save recipes for personal, non-commercial use;
- share links to pages of the Site;
- quote short excerpts with a live link to the source, within the limits of fair use permitted by law.
Without our written permission you may not:
- reproduce recipes, texts or photos in full or in substantial part on other websites, social media, apps or in print;
- use materials from the Site for commercial purposes;
- collect data from the Site by automated means (scraping, crawling for datasets) or use its materials to train or improve artificial intelligence systems. This is also an express reservation of rights against text and data mining within the meaning of Article 4 of Directive (EU) 2019/790;
- use the Smakota name or logo in a way that suggests you are affiliated with us.
5. Ratings and messages from users
By sending a recipe rating or a message through the contact form you confirm that it does not break the law or infringe anyone’s rights. We may use your feedback and suggestions free of charge to improve the Site, without disclosing your name or contact details unless you agree. How we process personal data is described in the Privacy Policy.
6. Prohibited use
- interfering with the Site, attempting unauthorised access or spreading malware;
- manipulating recipe ratings or sending spam;
- using the Site in any way that breaks the law.
7. Third-party links
The Site may link to third-party websites. We do not control them and are not responsible for their content, availability or privacy practices.
8. Limitation of liability
The Site is provided “as is”. We work to keep information accurate and up to date but do not guarantee that it is error-free or that the Site will always be available. To the extent permitted by law, we are not liable for any loss arising from the use of, or inability to use, the Site or its materials, including cooking results, allergic reactions or spoiled ingredients.
Nothing in these Terms limits liability that cannot be limited by law or affects the rights you have as a consumer under the mandatory laws of the country where you live.
9. Changes to the Site and the Terms
We may change, add to or remove materials on the Site and update these Terms. A new version takes effect when it is published on this page; the date at the top shows the current version.
10. Governing law and disputes
These Terms are governed by the laws of Ukraine. We aim to resolve any dispute by negotiation — please write to us first. If we cannot agree, the dispute will be decided by a court in accordance with the laws of Ukraine, subject to the mandatory consumer-protection rules of the country where you live.
